Armed Robbery Firearm The Defendant was accused of robbing two men with a co-defendant. After pre-filing the alleged victims, the State filed charges. Attorney Hernandez was hired on the case after the state had filed charges. Attorney Hernandez proceeded with discovery and forced the case to trial. Trafficking in Cocaine (2 Kilograms) The Defendant was accused of trafficking in two (2) kilograms of cocaine. Attorney Hernandez was hired after the case had been filed by the State Attorney’s Office. The Defendant was looking at a 15 year Minimum Mandatory prison sentence if found guilty at trial. Attorney Hernandez was able to negotiate a CTS plea where the client was given time served. The Defendant received no jail and no probation.

He was looking at a 3 year minimum mandatory if he was found guilty of possessing the firearm as a convicted felon. After trial, the jury returned a verdict of not guilty as to all counts.

Aggravated Assault with a Deadly Weapon The Defendant was accused of trying to run over his ex-wife’s lover with his car at a high rate of speed as the alleged victim walked in an apartment complex. After trial, the jury found the defendant not guilty of all charges.

3rd DUl The Defendant was arrested for a third DUI offense. Traditionally, the State attorney's office would require a long period of incarceration for such behavior. However, Mr. Hernandez was able to avoid jail for his client and convinced the State Attorney’s office that probation and no jail was appropriate.

Attempted Armed Robbery
The defendant was arrested and accused of being the getaway driver in an Armed Robbery which took place at a local convenience store. Mr. Hernandez made contact with the prosecutor during the pre-filing phase of the case. Mr. Hernandez convinced the prosecutor that the facts did not support the State Attorney’s Office filing charges on his client based on the principal theory. The state agreed and dismissed all the charges.

Domestic Battery by strangulation, False Imprisonment, Aggravated Assault and Tampering With a Witness
Defendant was accused of grabbing a females neck and dragging her to a bedroom. He then took bedsheets and covered her face to the point that her breathing was impeded. Defendant then began to hit her face. Mr. Hernandez pushed the case to trial and the state dismissed all the charges on the trial date.
